What is a Statutory Demand?
A Statutory Demand is a notice in the form of request for repayment of full amount from a creditor (someone who is owed money) for payment of a debt. The person or company that receives the demand has 21 days to settle the debt or ask the court to aside (dismiss) the demand. The creditor may present a petition to court for a bankruptcy order or winding-up order if, after 21 days, a statutory demand claiming a debt of more than £750 is not:
- Paid
- Secured (an agreement reached for payment), or
- Set aside.
There are two types of Statutory Demand Notice forms:
- Form 4.1 (under section 123(1)(a) or 222(1)(a) of the Insolvency Act 1986) is used if the debt is against the Company; and
- Form 6.1 (under section 268(1)(a) of the Insolvency Act 1986) is used if the debt is against the individual.
