Challenging Council Tax Liability

Our client received a copy of an application for an order for sale due to non-payment of council tax by the tenants.

We wrote to the council that there is no equity in the property to obtain an order for sale.

Council were also challenging the second charge on the property through county court. We have also informed the council that county court has no jurisdictional entertain their application.

Finally, the matter was heard before the county court where District Judge has rejected the entire application whereby council suffered a financial loss of £50,000 (council tax, interest and legal costs) for presenting misconstrued application.
